BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: Property located at 101 Oyler Lane, being off the northeast line of Oyler Lane northwest of Highway 153. Part of the James G. Hamill Division, not recorded; being part of the property described as Tract 1 in deed book 3092, page 299, ROHC. To find the true point of beginning of said part of tract, start on the northeast line of Oyler Lane 89.04 feet southwest of the intersection of the northwest line of Oyler Lane with the northwest line of Highway 153, said point being the most southerly corner of lot 1, North Gate Motors Subdivision, as shown by plat of record in plat book 37, page 137, ROHC, thence northeast some 10 feet with the northwest line of said lot 1 to a point 10 feet (if measured at a right angle) northeast of the northeast line of Oyler Lane, the true point of beginning, thence northwest some 207 feet parallel to, and at all points 10 feet northeast of, the northeast line of Oyler Lane, thence northeast some 248 feet to the southeast corner of lot 83, North Woods Subdivision Unit 1, as shown by plat of record in plat book 23, page 38, ROHC, said point also being the most westerly corner of said lot 1, North Gate Motors Subdivision, thence southeast 266.1 feet with the southwest line of said lot 1, thence southwest some 111.28 feet (plat), or 125 feet (map), with the northwest line of said lot 1 to the true point of beginning. Tax Map No. 99E-B-11 (part). from R-3 Residential Zone to C-2 Convenience Commercial Zone. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. Rezoning to exclude 10' strip along the south line; 2. No access from rezoned area to Oyler Lane; 3. A 6' fence with sight-obscuring landscaping along the Oyler Lane side of the property in conformance with the screening provisions required under the M-3 zone; 4. All lighting is to be directed away from the apartments on the west side and the residential area to the south; and 5. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, as required by law.
